Personal data protection

If you are a customer, newsletter subscriber or visitor to our website, you are entrusting us with your personal data. We are responsible for their protection and security. Please familiarize yourself with the data protection, policies and rights you have in relation to the GDPR (General Data Protection Regulation).

Who is the administrator?

We are Smart Coach, s.r.o., company registration number 14295628, with registered office at Příčná 1892/4, Nové Město, 110 00 Prague 1, Czech Republic; registered at the Municipal Court in Prague under file number C 363336. We process your personal data as a controller, i.e. we determine how the personal data will be processed and for what purpose, for how long and we select any other processors who will assist us with the processing.

Statement

We declare that as the controller of your personal data we comply with all legal obligations required by applicable legislation, in particular the Data Protection Act and the GDPR, and therefore that:

• we will only process your personal data on the basis of a valid legal ground, in particular a legitimate interest, the performance of a contract, a legal obligation or consent,
• we comply with the information obligation under Article 13 of the GDPR prior to the processing of personal data, 
• we will enable and support you in exercising and fulfilling your rights under the Data Protection Act and GDPR.

Scope of personal data and purposes of processing

We process personal data that you entrust to us for the following reasons (to fulfil these purposes):

• Provision of services, performance of the contract:
  We need your personal data in the scope of: e-mail and phone number for the performance of the contract.
• Bookkeeping:
  If you are a customer, we necessarily need your personal data (billing data) in order to comply with the legal obligation to issue and record tax documents.
• Marketing - sending newsletters:
  We use your personal data (email and name), gender, what you click on in the email and when you open it most often for the purpose of direct marketing - sending you commercial communications. If you are a customer, we do this out of legitimate interest, as we reasonably expect you to be interested in our newsletters, for a period of 5 years from the last order.
  If you are not our customer, we only send you newsletters based on your consent, for a period of 5 years from the date of granting. In either case, you can withdraw this consent by using the unsubscribe link in each email sent.
• Advanced consent-based marketing:
  Only on the basis of your consent, we may also send you inspiring offers from third parties or use your email address for e.g. remarketing and targeting advertising on Facebook, Instagram, LinkedIn, Google Ads, Sklik for a period of 5 years from the date of your consent. This can of course be revoked at any time via our contact details.
• Photographic documentation - live events, e.g. training, conferences.

We retain your personal data for the duration of the limitation periods, unless the law provides for a longer retention period or we have stated otherwise in specific cases.

Security and protection of personal data

We protect personal data to the maximum extent possible by using modern technologies that correspond to the state of the art. We protect it as if it were our own. We have adopted and maintain all possible (currently known) technical and organizational measures to prevent the misuse, damage or destruction of your personal data.

Transfer of personal data to third parties

Your personal data can be accessed by our employees and associates.

For specific processing operations that we cannot provide ourselves, we use the services and applications of processors who can protect the data even better than we can and specialise in the processing in question.

They are providers of platforms or services for project management, direct marketing and accounting.

It is possible that in the future we may decide to use other applications or processors to facilitate and improve the quality of processing. However, we promise you that in such a case, we will place at least the same demands on the processor in terms of security and quality of processing as we place on ourselves.

Transfer of data outside the European Union

We only process data in the European Union or in countries that provide an adequate level of protection based on a decision of the European Commission.

Your rights in relation to the protection of personal data

You have right to informationwhich is already fulfilled by this information page with the principles of personal data processing.

Thanks the right of access you can ask us at any time and we will document within 30 days what personal data we are processing and why.

If something changes about you or you find your personal data outdated or incomplete, you have the right to supplement and amend personal data.

Right to restriction You can use the processing if you believe that we are processing your inaccurate data, if you believe that we are processing unlawfully but you do not want to delete all the data or if you have objected to the processing.

You can limit the scope of the personal data or the purposes of the processing. (For example, by unsubscribing from the newsletter, you limit the purpose of the processing for sending commercial communications.)

Right to portability

If you would like to take your personal data and transfer it to someone else, we will do the same as we do when you exercise your right of access - the only difference is that we will supply the information to you in machine-readable form. Here we need at least 30 days.

The right to have your data deleted from our database (to be forgotten)

Your other right is the right to erasure (to be forgotten). We don't want to forget you, but if you wish, you have the right to do so. In this case, we will delete all your personal data from our system and from the system of all sub-processors and backups. We need 30 days to secure the right to erasure.

In some cases, we are bound by a legal obligation and, for example, I have to keep records of the tax documents issued for the period prescribed by law. In this case, we will therefore delete all such personal data that is not bound by another law. We will inform you by e-mail when the deletion is completed.

Complaint to the Office for Personal Data Protection

If you feel that we are not treating your data in accordance with the law, you have the right to contact the Office for Personal Data Protection at any time with your complaint. We would be very happy if you first inform us of this suspicion so that we can do something about it and correct any wrongdoing.

Unsubscribe from newsletters and commercial communications

We send you emails with news, articles or products and services if you are a customer based on our legitimate interest.

If you are not yet a customer, we only send them to you on the basis of your consent. In either case, you can stop receiving our emails by pressing the unsubscribe link in each email sent.

Silence

We would like to assure you that our employees and associates who will process your personal data are obliged to maintain confidentiality of personal data and security measures, the disclosure of which would jeopardize the security of your personal data. This the confidentiality obligation continues even after the end of the contractual relationship with us. Your personal data will not be released to any other third party without your consent.

This personal data processing policy applies from 1 December 2021.

Cookies

When you browse our website, we record your IP address, how long you stay on the site and which page you come from. We see the use of cookies to measure website traffic and to customize the display of the website as a legitimate interest of the administrator, as we believe that this allows us to offer you an even better service.

Smart Coach s.r.o. is a data controller and uses cookies on its website for the following purposes:

• measuring website traffic, generating statistics on traffic and visitor behaviour on its website,
• the functioning of its website,
• for optimising ads on social networks (e.g. Facebook),
• to optimize AdWord and Sklik ads.

It concerns the processing of personal data

The collection of cookies for the purpose referred to in the preceding paragraph may be considered as processing of personal data. Such processing is possible on the basis of a lawful reason and is made possible by Article 6(1)(f) from Regulation (EU) of the European Parliament and of the Council č. 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (formerly also referred to as the "Regulation").

It's in your hands

You can use the website in a mode that does not allow the collection of visitor data. This mode can be set in your browser. Data collection can be opposed on the basis of Article 21 in the Regulation also object by sending it to the contact address of Smart Coach s.r.o. or by e-mail to info@weboptim.cz. We will evaluate your objection no later than 30 days from the moment we receive it. Cookies necessary for the functionality of the website will be stored only for the time necessary for the functioning of the website.

What we unfortunately can't guarantee

If you object to the processing of technical cookies necessary for the functioning of the Smart Coach s.r.o. website, the full functionality and compatibility of the website cannot be guaranteed.

Cookies, which are collected for the purpose of measuring traffic to the Smart Coach s.r.o. website, generating traffic statistics and visitor behaviour on the website, are considered in bulk and pseudonymised form, which allows the identification of an individual only with considerable and professional effort.

We evaluate the data as a whole

The cookies used by Smart Coach s.r.o. for the optimisation of advertisements on social networks (e.g. Facebook), AdWords and Sklik are, as in point 4, treated in bulk and in pseudonymised form.

You can take back your decision

Advertising targeting cookies are processed on the basis of your consent. You grant this for the period of time indicated for each marketing cookie. You can withdraw your consent to the collection of cookie data for marketing purposes at any time by changing the settings of the relevant internet browser.

• Facebook Inc., California, USA

The aforementioned data processors further handle cookies in accordance with their terms and conditions, which can be found on their websites.

What you are entitled to

• You have the right to request information from Smart Coach s.r.o., which operates the website referred to in point 1, about your personal data processed by the company. In addition, you can request a copy of it.
• You also have the right to request access to your personal data from the above-mentioned company and to have it updated or corrected, or to restrict its processing.
• You may request the deletion of your personal data. Smart Coach s.r.o. will only do this if the deletion is not contrary to applicable law and the legitimate interests of the company.
• In the case of processing of personal data on the basis of consent, you have the right to request the transfer of such data.
• If you have any doubts about compliance with the obligations related to the processing of personal data, it is your right to contact Smart Coach s.r.o. or the Office for Personal Data Protection or, in extreme cases, the court.
